Decreta
LEY DE REGISTROS Y NOTARÍAS
Artículo 1. Se modifica el artículo 29, quedando redactado de la siguiente forma:
La siguiente,
Habilitación
Artículo 29. La habilitación de las horas del despacho se hará sólo en caso de urgencia jurada y comprobada por la Registradora y Registrador o Notaria Pública o Notario Público, quienes deberán inscribir, protocolizar o autenticar los documentos o actos en un plazo menor a tres días, en los siguientes casos:
- La inscripción de testamentos abiertos o cerrados.
- Los títulos o certificados académicos, científicos, eclesiásticos y los despachos militares.
- Las legalizaciones.
- Las autorizaciones de niñas, niños o adolescentes para viajar.
- La inscripción de demandas y poderes, así como la sustitución, renuncia y revocatorias de los mismos en materia laboral.
- La designación de tutores, curadores o consejeros de tutela.
- Las actas de remate.
- Las copias certificadas de los libelos de demanda para interrumpir la prescripción y surtir otros efectos.
- Los poderes, sustituciones, renuncias y revocatorias de los mismos.
- Los documentos que contengan declaraciones de limitaciones, transmisiones, derecho de retracto, renuncias o gravámenes de la propiedad.
- Los decretos de interdicción e inhabilitación civil.
- Los protestos de cheques, de conformidad con lo previsto en el Código de Comercio.
- La certificación de gravámenes.
- Las copias certificadas de todos aquellos actos o instrumentos que reposen en los archivos de los Registros y Notarías.
- Los demás que establezcan las leyes y las providencias emanadas de la máxima autoridad del Servicio Autónomo de Registros y Notarías.
En los casos de los numerales 1, 2, 3, 7, 8, 9, 10, 11, 12, 13 14 y 15, se requerirá el pago de hasta seis unidades de petro (6 PTR) adicionales, de conformidad con la providencia que al efecto dicte la Directora o Director General del Servicio Autónomo de Registros y Notarías.
Los montos previstos en este artículo se pagarán en bolívares al valor del petro vigente a la fecha de la solicitud.
Artículo 2. Se modifica el artículo 83, quedando redactado de la siguiente forma:
Tasas por concepto de prestación de servicio
Artículo 83. El Servicio Autónomo de Registros y Notarías, así como las oficinas de Registros Principales y Registros Públicos, cobrarán las siguientes tasas por concepto de prestación de servicio:
- Hasta cinco décimas de petro (0,5 PTR) por el primer año y hasta una unidad de petro (1 PTR) por cada uno de los años siguientes, por la solicitud de documentos o expedientes, cuando no se indique con exactitud el nombre del otorgante, el año en que se otorgó el documento y la oficina en que se registró. Cuando se dieren estas indicaciones nada se cobrará al interesado, a menos que se encuentre el documento sin estar de acuerdo con los datos suministrados.
- Hasta una unidad y media de petro (1,5 PTR) por el primer año y hasta tres décimas de petro (0,30 PTR) por cada uno de los años siguientes, que abarque las averiguaciones que deban llevarse en los libros o registros electrónicos, para certificar si una propiedad ha sido o no hipotecada o gravada en cualquier otra forma o si ha sido enajenada. Los mismos derechos se cobrarán por certificar si existe registrado cualquier acto, título o contrato del que se pida constancia.
- Hasta una unidad de petro (1 PTR) por la certificación que se expida de los expedientes, planos o documentos de cualquier especie archivados o inscritos en la respectiva oficina.
- Hasta dos décimas de petro (0,20 PTR) por el primer folio y hasta una décima de petro (0,10 PTR) por cada uno de los siguientes, por las copias certificadas de documentos inscritos.
- Hasta una décima de petro (0,10 PTR) por cada folio de las copias o reproducciones simples de los documentos inscritos.
- Hasta una unidad de petro (1 PTR) por la comprobación o legalización de cada firma ante los Registros Principales y hasta dos unidades de petro (2 PTR) por la legalización de firmas de los Registradores Principales ante el Servicio Autónomo de Registros y Notarías.
- Como derecho de procesamiento de documentos de venta, constitución de hipotecas; parcelamiento, cesiones; dación o aceptación en pago, permutas, adjudicaciones de bienes inmuebles en remate judicial, particiones de herencias, de sociedades o de compañías y cualquier otro contrato o transacción en que la prestación consista como arrendamientos, rentas vitalicias, censos, servidumbres y otros semejantes, aportaciones de bienes inmuebles, muebles u otros derechos para la constitución de sociedades: a. Hasta quinientas unidades de petro (500 PTR), el cero coma cincuenta por ciento (0,50%). b. Desde quinientas una unidad de petro (501 PTR) hasta mil unidades de petro (1.000 PTR), el uno por ciento (1 %). c. Más de mil unidades de petro (1.001 PTR) en adelante, el dos por ciento (2%).
- Hasta quinientas unidades de petro (500 PTR), el cero coma cincuenta por ciento (0,50%).
- Desde quinientas una unidad de petro (501 PTR) hasta mil unidades de petro (1.000 PTR), el uno por ciento (1 %).
- Más de mil unidades de petro (1.001 PTR) en adelante, el dos por ciento (2%).
- Hasta cuatro décimas de petro (0,40 PTR) por cada folio de los documentos presentados para su inscripción por concepto de gastos del servicio de fotocopiado.
- Hasta dos décimas de petro (0,20 PTR) por cada testigo instrumental designado por la Registradora o Registrador, si la interesada o interesado no lo presenta.
- Hasta una unidad de petro (1 PTR) por los recaudos que deben agregarse al cuaderno de comprobantes.
- Hasta dos unidades de petro (2 PTR) por el primer folio y hasta ocho décimas de petro (0,80 PTR) por los folios siguientes, por la transcripción de un documento manuscrito al sistema computarizado o por su digitalización.
- Hasta ocho décimas de petro (0,80 PTR) por cada nota que deba estamparse al margen de los contratos y actos inscritos anteriormente, de conformidad con las disposiciones del Código Civil o leyes especiales.
- Hasta ocho décimas de petro (0,80 PTR) por la cita que deba hacerse en las notas de registro cuando se trate de actos traslativos de la propiedad de inmuebles o derechos reales sobre los mismos, o que impongan gravámenes o limitaciones sobre los mismos bienes y el interesado no indique el o los títulos de propiedad inmediatamente anteriores.
- Hasta dos unidades de petro (2 PTR) por el registro de poderes especiales y generales e iguales derechos por el de sus respectivas sustituciones, revocatorias y renuncias; así como la misma cantidad por todo contrato, transacción o acto que verse sobre derechos no apreciables en dinero.
- Hasta dos décimas de petro (0,20) por la inscripción de los títulos y certificados académicos, científicos y eclesiásticos, así como los despachos militares.
- Como derecho de procesamiento por la inscripción de asociaciones y sociedades civiles: por un folio, hasta dos petros (2 PTR); por dos folios, hasta tres petros (3 PTR); por tres folios, hasta cinco petros (5 PTR); por cuatro folios, hasta siete petros (7 PTR); por cinco folios, hasta nueve petros (9 PTR); por seis folios, hasta once petros (11 PTR); y por más de seis folios, hasta trece petros (13 PTR).
- Por el derecho de procesamiento por la inscripción de sentencias de divorcio, separaciones de cuerpos, y nulidad del matrimonio: por un folio, hasta dos petros (2 PTR); dos folios, hasta tres petros (3 PTR); tres folios, hasta cuatro petros (4 PTR); cuatro folios, hasta cinco petros (5 PTR); cinco folios, hasta seis petros (6 PTR); seis folios, hasta siete petros (7 PTR); y más de seis folios, hasta ocho petros (8 PTR).
- Hasta cinco unidades de petro (5 PTR) por el sellado de libros.
- Como derecho de procesamiento de inscripción de capitulaciones matrimoniales, hasta cincuenta unidades de petro (50 PTR).
- Hasta cuatro unidades de petro (4 PTR) por el primer folio y hasta una unidad de petro (1 PTR) por cada uno de los siguientes, por la protocolización de los testamentos abiertos. En caso de testamentos cerrados hasta cinco unidades de petro (5 PTR), por la protocolización.
- Hasta cinco unidades de petro (5 PTR) por el derecho de procesamiento por la inscripción de mejoras y bienhechurías y sentencias de título supletorio.
- Hasta cinco unidades de petro (5 PTR) por la venta de derechos y acciones.
La Directora o Director General del Servicio Autónomo de Registros y Notarías, establecerá mediante providencia el monto de las tasas aplicables en cada caso, dentro de los límites previstos en este artículo. Una copia de esta providencia en letra de tamaño no menor de un centímetro (1 cm) y el valor del petro en bolívares para el día, se fijará en un lugar visible al público en todas las oficinas de registro y en los portales digitales y redes, bajo pena de multa de diez petros (10 PTR), que será impuesta a la Registradora o Registrador titular, la cual deberá ser enterada al Servicio Autónomo de Registros y Notarías, en un lapso no mayor a treinta días.
Las tasas previstas en este artículo se pagarán en bolívares al valor del petro vigente a la fecha de la solicitud.
Artículo 3. Se modifica el artículo 84, quedando redactado de la siguiente forma:
Procesamiento
Artículo 84. Las Registradoras o Registradores no podrán cobrar más de una unidad de petro (1PTR) por el total de las cantidades correspondientes a derechos de procesamiento, notas marginales y tasas, cuando el valor de la operación que vaya a inscribirse sea inferior a cien unidades de petro (100 PTR).
Una copia de este artículo en letras de tamaño no menor de un centímetro (1 cm), expresados en petros y el valor del petro para el día, se fijará en un lugar visible al público en todas las oficinas de registro, bajo pena de multa de diez petros (10 PTR), que será impuesta a la Registradora o Registrador titular, la cual deberá ser enterada al Servicio Autónomo de Registros y Notarías, en un lapso no mayor a treinta días.
La tasa prevista en este artículo se pagará en bolívares al valor del petro vigente a la fecha de la solicitud. Artículo 4. Se modifica el artículo 85, quedando redactado de la siguiente forma:
Tasas en materia no contenciosa mercantil
Artículo 85. En materia no contenciosa mercantil se causarán las siguientes tasas a favor del Servicio Autónomo de Registros y Notarías:
- Por la inscripción de cualquier tipo de sociedades, firmas personales y asociaciones de cuentas en participación, hasta una unidad de petro (1 PTR), más hasta cinco décimas de petro (0,5 PTR) por cada folio que contenga el documento o actuación.
- Por la inscripción de cualquier acta de asamblea o junta directiva; modificaciones al documento constitutivo de firmas personales o de cuentas en participación y documentos por los cuales se declare la disolución, liquidación, extinción o prórroga de su duración, hasta una unidad de petro (1 PTR), más hasta cinco centenas de petro (0,05 PTR) por cada folio que contenga el documento.
- Por la inscripción de sociedades extranjeras, domiciliaciones o establecimiento de agencias, representaciones, o sucursales de las mismas, hasta cien unidades de petro (100 PTR), más hasta una unidad de petro (1 PTR) por cada folio que contenga el documento.
- Por la inscripción de documento de ventas de cuotas de participación, de fondos de comercio, cesión de firmas personales, hasta seis unidades de petro (6 PTR), más hasta cinco centésimas de petro (0,05 PTR) por cada folio que contenga el documento.
- Por la inscripción de poderes, factores mercantiles, sentencias o cualquier otro documento emanado de tribunales u otros organismos o autoridades, hasta cinco unidades de petros (5 PTR), más hasta cinco centésimas de petro (0,05 PTR) por cada folio que contenga el documento.
- Por cada folio de documento que se acompañe con el recaudo presentado para inscripción, hasta cinco centésimas de petro (0,05 PTR).
- Por cualquier otro tipo de documento que se presente para su inscripción no incluido en los numerales anteriores, hasta una unidad de petro (1 PTR), más hasta cinco centésimas de petro (0,05 PTR) por cada folio que contenga el documento.
- Por agregar documentos y anexos a los expedientes, hasta diez décimas de petro (0,10 PTR), más hasta cinco centésimas de petro (0,05 PTR) por cada folio.
- Por estampar cada nota marginal, hasta una décima de petro (0,10 PTR).
- Por el sellado de libros y por el sellado de certificados, títulos, acciones, cédulas y cualquier tipo de papeles mercantiles, hasta cinco unidades de petro (5 PTR), más una centésima de petro (0,01 PTR) por cada folio que contenga el libro o los papeles a ser sellados.
- Se causarán como gastos de procesamiento, el servicio por sistema de fotocopiado hasta una décima de petro (0,10 PTR), por cada una de las fotocopias necesarias para el procesamiento de registro de los documentos o actuaciones, así como para las copias certificadas, certificaciones, constancias y copias simples que deban ser emitidas o sean solicitadas por los interesados.
- Por las copias certificadas de documentos registrados, hasta dos décimas de petro (0,20 PTR) por el primer folio y cinco centésimas de petro (0,05 PTR) por cada uno de los siguientes.
- Hasta dos unidades de petro (2 PTR) por la búsqueda y selección de nombres, denominaciones sociales o comerciales.
- Por la inscripción y aumento de capital de sociedades mercantiles se cobrará hasta el dos por ciento (2%) del capital.
- Hasta cinco unidades de petro (5 PTR) por el cambio de domicilio.
- Hasta cien unidades de petro (100 PTR) por la inscripción de consorcios, sociedad empresarial o sociedad gestora, más hasta un petro (1 PTR) por cada folio que contenga el documento.
- Hasta cinco unidades de petro (5 PTR) por la inscripción de la venta de acciones. 18. Hasta cinco unidades de petro (5 PTR) por la inscripción de fusiones compañías.
La Directora o Director General del Servicio Autónomo de Registros y Notarías, establecerá mediante providencia el monto de las tasas aplicables en cada caso, dentro de los límites previstos en este artículo. Una copia de esta providencia en letra de tamaño no menor de un centímetro (1 cm) y el valor del petro en bolívares para el día, se fijará en un lugar visible al público en todas las oficinas de registro y en los portales digitales y redes, bajo pena de multa de diez petros (10 PTR), que será impuesta a la Registradora o Registrador titular, la cual deberá ser enterada al Servicio Autónomo de Registros y Notarías, en un lapso no mayor a treinta días. Las tasas previstas en este artículo se pagarán en bolívares al valor del petro vigente a la fecha de la solicitud.
Artículo 5. Se modifica el artículo 86, quedando redactado de la siguiente forma:
Tasas en materia no contenciosa, civil, Mercantil y contenciosa administrativa
Artículo 86. En materia no contenciosa, civil, mercantil y contenciosa administrativa, en el recinto de la Notaría Pública se causarán las siguientes tasas a favor del Servicio Autónomo de Registros y Notarías:
- Hasta una unidad de petro (1 PTR) como derecho de procesamiento del documento original presentado para su autenticación y hasta una décima de petro (0,10 PTR) por las copias certificadas.
- Otorgamiento de autorizaciones, hasta cuatro centésimas de petro (0,04 PTR) por cada folio.
- Apertura de testamento, hasta cinco unidades de petro (5 PTR). Cuando abierto el testamento resultare que su contenido sólo se limita al reconocimiento de filiación, no se cobrará derecho alguno.
- Otorgamiento de justificativos, hasta una décima de petro (0,10 PTR) por cada folio.
- Por el otorgamiento de poderes, hasta dos unidades de petro (2 PTR).
- Documentos autenticados, hasta cuatro décimas de petro (0,40 PTR) el primer folio y hasta cinco centésimas de petro (0,05 PTR) por cada uno de los restantes. Ejemplares adicionales a un solo efecto, hasta una décima de petro (0,10 PTR) por cada uno. En los reconocimientos solo se cobrará la mitad de este derecho.
- Actuaciones para dar fecha cierta de cualquier tipo de documentos, hasta dos unidades de petro (2 PTR).
- Nombramiento de curadoras y curadores, hasta una décima de petro (0,10 PTR), salvo los casos previstos en materia de niñas, niños y adolescentes.
- Por la transcripción de un documento manuscrito al sistema computarizado o por su digitalización, hasta dos unidades de petro (2 PTR) por el primer folio y por cada folio adicional hasta cuatro décimas de petro (0,40 PTR).
- Por las copias certificadas de documentos autenticados, hasta dos décimas de petro (0,20 PTR) por el primer folio y hasta cinco centésimas de petro (0,05 PTR) por cada uno de los siguientes.
- Por la copias o reproducciones simples de los documentos autenticados, hasta una décima de petro (0,10 PTR).
- Documentos anexos o complementarios a los que se autentiquen, hasta una décima de petro (0,10 PTR) por cada uno de ellos.
- Por estampar cada nota marginal, hasta ocho décimas de petro (0,80 PTR).
- Servicio y custodia de los instrumentos privados a que se contrae el artículo 1.369 del Código Civil, hasta una unidad de petro (1 PTR) anuales.
- Actas notariales, hasta una unidad de petro (1 PTR) por cada folio.
- Por la práctica de citaciones judiciales, hasta cuatro unidades de petro (4 PTR) por todo el procedimiento previsto en el primer aparte del artículo 345 del Código de Procedimiento Civil.
- Por el otorgamiento de contratos de arrendamiento para uso comercial, hasta cinco unidades de petro (5 PTR).
- Por el otorgamiento de contratos de opciones de compra-venta de bienes inmuebles, hasta dos unidades de petro (2 PTR).
- Por la compra-venta de vehículos a motor y maquinaria pesada, se estimará de acuerdo a la modalidad y al año de fabricación del vehículo considerando lo siguiente:
a) Motocicletas: superiores a veinte (20) años de fabricación, hasta una unidad de petro (1 PTR); de once (11) años a veinte (20) años de fabricación, hasta dos unidades de petro con cinco décimas (2,50 PTR) y desde un (1) año a diez (10) años de fabricación, hasta cuatro unidades de petro con dos décimas (4,20 PTR). b) Vehículo particular: superiores a veinte (20) años de fabricación, hasta una unidad de petro (1 PTR); de once (11) años a veinte (20) años de fabricación, hasta tres unidades de petros (3 PTR) y desde un (1) año a diez (10) años de fabricación, hasta cinco unidades de petros (5 PTR). c) Camioneta: superiores a veinte (20) años de fabricación, hasta dos unidades de petros (2 PTR); de once (11) años a veinte (20) años de fabricación, hasta cuatro unidades de petros (4 PTR) y
desde un (1) año a diez (10) años de fabricación, hasta seis unidades de petros (6 PTR). d) Vehículo de carga y maquinaria pesada: superiores a veinte (20) años de fabricación, hasta cuatro unidades de petro (4 PTR); de once (11) años a veinte (20) años de fabricación, hasta seis unidades de petros (6 PTR) y desde un (1) año a diez (10) años de fabricación, hasta diez unidades de petros (10 PTR). e) Autobuses: superiores a veinte (20) años de fabricación, hasta cuatro unidades de petro (4 PTR); de once (11) años a veinte (20) años de fabricación, hasta seis unidades de petros (6 PTR) y desde un (1) año a diez (10) años de fabricación, hasta diez unidades de petros (10 PTR).
- Por el otorgamiento de contratos de compra-venta de aeronaves en las oficinas competentes hasta treinta unidades de petro (30 PTR) para aeronaves menores o iguales a 5.700 kgm de peso máximo de despegue y mayores a 15 años de fabricación; hasta cincuenta unidades de petros (50 PTR) para aeronaves menores o iguales a 5.700 kgm de peso máximo de despegue con menos de 15 años de fabricación. Asimismo, por el otorgamiento de actos que devengan de la administración, custodia, uso o goce del bien, hasta diez unidades de petro (10 PTR).
- Por el otorgamiento de contratos de compra-venta de embarcaciones, se causarán tasas de acuerdo a lo siguiente: a) Menor de cinco unidades de arqueo bruto (5 AB), hasta cuatro unidades de petro (4 PTR). b) Entre cinco unidades de arqueo bruto (5 AB) y cincuenta unidades de arqueo bruto (50 AB), hasta ocho unidades de petro (8 PTR). c) Entre cincuenta y un unidades de arqueo bruto (51 AB) y cien unidades de arqueo bruto (100 AB), hasta dieciséis unidades de petro (16 PTR). d) Entre ciento un unidades de arqueo bruto (101 AB) y trescientas unidades de arqueo bruto (300 AB), hasta veinte unidades de petro (20 PTR). e) Entre trescientas un unidades de arqueo bruto (301 AB) y quinientas unidades de arqueo bruto (500 AB), hasta treinta unidades de petro (30 PTR).
La Directora o Director General del Servicio Autónomo de Registros y Notarías, establecerá mediante providencia el monto de las tasas aplicables en cada caso, dentro de los límites previstos en este artículo. Una copia de esta providencia en letra de tamaño no menor de un centímetro (1 cm) y el valor del petro en bolívares para el día, se fijará en un lugar visible al público en todas las oficinas de notaría y en los portales digitales y redes, bajo pena de multa de diez petros (10 PTR), que será impuesta a la Notaria Pública o Notario Público, la cual deberá ser enterada al Servicio Autónomo de Registros y Notarías, en un lapso no mayor a treinta días.
Las tasas previstas en este artículo se pagarán en bolívares al valor del petro vigente a la fecha de la solicitud.
Artículo 6. Se modifica el artículo 87, quedando redactado de la siguiente forma:
Tasas por actuaciones fuera del recinto
Artículo 87. En materia no contenciosa, fuera del recinto de la Notaría Pública, se causarán las siguientes tasas a favor del Servicio Autónomo de Registros y Notarías:
- Inspecciones oculares, experticias, actas notariales y demás probanzas, hasta dos unidades de petro (2 PTR) por cada hora o fracción que dure menos de una hora. Las fracciones siguientes se cobrarán en proporción a cada hora.
- Entrega material de bienes vendidos, hasta dos unidades de (2 PTR).
- En la formación de inventario, hasta una unidad de petro (1 PTR) la primera hora y hasta cinco décimas de petro (0,50 PTR) cada una de las siguientes o fracción de ellas mayor de quince minutos. Esta actuación no causará derechos si se realiza en razón de la aceptación de una herencia a beneficio de inventario, por quienes tuvieren niñas, niños y adolescentes bajo su patria potestad o tutela o en interés de estos o de inhabilitados o entredichos.
- Levantamiento de protestos, hasta dos unidades de petro (2 PTR) si el monto del instrumento es mayor de cincuenta unidades de petros (50 PTR) y hasta una unidad de petro (1 PTR) si el monto es menor.
- Otras constituciones, hasta una unidad de petro (1 PTR) cada hora o fracción que dure menos de una hora. Las fracciones siguientes se cobrarán en proporción a cada hora.
La Directora o Director General del Servicio Autónomo de Registros y Notarías, establecerá mediante providencia el monto de las tasas aplicables en cada caso, dentro de los límites previstos en este artículo. Una copia de esta providencia en letra de tamaño no menor de un centímetro (1 cm) y el valor del petro en bolívares para el día, se fijará en un lugar visible al público en todas las oficinas de notaría y en los portales digitales y redes, bajo pena de multa de diez petros (10 PTR), que será impuesta a la Notaria Pública o Notario Público, la cual deberá ser enterada al Servicio Autónomo de Registros y Notarías, en un lapso no mayor a treinta días.
Las tasas previstas en este artículo se pagarán en bolívares al valor del petro vigente a la fecha de la solicitud.
Artículo 7. Se modifica el artículo 88, quedando redactado de la siguiente forma:
Traslados
Artículo 88. Por el acto de traslado fuera de la oficina, hasta cuatro unidades de petro (4 PTR), entre las seis de la tarde y las seis de la mañana. Días feriados o no laborables hasta seis unidades de petro (6 PTR). Los gastos de transporte de ida y vuelta, así como otros que ocasione la asistencia de la Registradora o Registrador, Notaria o Notario, funcionaria o funcionario, los fijará el Servicio Autónomo de Registros y Notarías, de acuerdo con la distancia entre la oficina y el lugar del otorgamiento.
La Directora o Director General del Servicio Autónomo de Registros y Notarías, establecerá mediante providencia el monto de las tasas aplicables en cada caso, dentro de los límites previstos en este artículo. Una copia de esta providencia en letra de tamaño no menor de un centímetro (1 cm) y el valor del petro en bolívares para el día, se fijará en un lugar visible al público en todas las oficinas de registro y de notaría y en los portales digitales y redes, bajo pena de multa de diez petros (10 PTR), que será impuesta a la Registradora o Registrador o Notaria Pública o Notario Público, la cual deberá ser enterada al Servicio Autónomo de Registros y Notarías, en un lapso no mayor a treinta días.
Las tasas previstas en este artículo se pagarán en bolívares al valor del petro vigente a la fecha de la solicitud.

Disposición Transitoria ÚNICA: La providencia que establezca las tasas aplicables a los supuestos previstos en esta Ley, será dictada por el Ejecutivo Nacional, oída la opinión de la Asamblea nacional dentro de los quince (15) días siguientes a su publicación.
