Gobierno exonera del pago del ISLR a personas naturales con menos de tres salarios mínimos vigentes al 31 dic. 2019

Para aquellas personas naturales que ya efectuaron el pago total o parcial de la alícuota del ISLR serán acreedoras de créditos fiscales equivalentes al monto pagado, los cuales podrán ser utilizados en pagos correspondientes a ejercicios posteriores

El gobierno de Nicolás Maduro publicó la Gaceta Extraordinaria N° 6.523 en la que, mediante el Decreto N° 4.171, se establece la exoneración a personas naturales del pago del Impuesto Sobre la Renta (ISLR) correspondiente al ejercicio fiscal del año 2019.

Todo ciudadano que al cierre del período fiscal de 2019 generase ingresos inferiores a tres salarios mínimos vigentes al 31 de diciembre de 2019 quedan exentos de realizar el pago correspondiente a la declaración de impuestos.

«Se exonera del pago del Impuesto sobre la Renta, el enriquecimiento anual de fuente territorial, obtenido por las personas naturales residentes en el país, durante el periodo fiscal del año 2019, cuyo salario normal o ingreso proveniente del ejercicio de su actividad, al cierre de dicho periodo no supere el monto equivalente a tres (3) salarios mínimos vigentes al 31 de diciembre de 2019», indica el decreto.

Para aquellas personas naturales que ya efectuaron el pago total o parcial de la alícuota del ISLR serán acreedoras de créditos fiscales equivalentes al monto pagado, los cuales podrán ser utilizados en pagos correspondientes a ejercicios posteriores.

Es decir, el dinero pagado hasta la fecha será tomado en cuenta para posteriores pagos del ISLR, lo que se traduce en una inminente devaluación de la suma aportada, debido al proceso inflacionario que sufre Venezuela.

Después de tiempo

El gobierno destaca en el decreto que la medida es tomada debido a la aparición del coronavirus en Venezuela, lo que les obliga a «adoptar medidas suficientes que protejan a los venezolanos del impacto que pudiera acarrear la situación excepcional que se deriva de la necesaria atención de la pandemia».

La medida llega dos días después del vencimiento del plazo para declarar y pagar el ISLR, en un contexto que complica cualquier trámite ante el Servicio de Administración Aduanera y Tributaria (Seniat), debido a la cuarentena declarada por el gobierno de Maduro.

Distintas voces dentro del sector privado solicitaron al Seniat extender el plazo para declarar y pagar el ISLR dada la situación coyuntural que atraviesa el país. Sin embargo, los llamados fueron ignorados por el ente estatal, que hasta el 30 de marzo seguía exhortando a los contribuyentes hacer el pago a través de la banca electrónica.
